All 3 Suspects in Aruba Case to Be Freed
All three men jailed in the disappearance of an Alabama teenager three months ago will go free Saturday, according to a judge's order a development legal observers on Aruba said shows the government had no case.

This is just so sad. My heart brakes for the Twitty-Holloway Family. As much as we know that all 3 had involvement in Natalee's disapperanc they really cant hold them without evidence. I hope soon, that someone talks or comes forward about the case. The Twitty-Holloway family need closure.

I am sick to my stomach over the Aruban developments. First they let Joran
go and now the Kalpoe brothers. At first I hoped it was some kind of strategy to let joran go and maybe the brothers would talk. Now I think they
did what they always planned to do - ignore this case - and the recent
hurricane here has kept the media busy reporting on other things so they
think they're not in the spotlight anymore. We've got to somehow
get the media back over there asking questions and demanding some answers.
I know the hurricane issue is important but they can surely spare someone
to get back to Aruba and finish what was started. Its so obvious that as soon as
the media was not asking questions and keeping the focus on the investigation they threw in the towel and let these criminals free.

I don't think it is about absence of the media. It is just about they cann't hold them longer according the law without hard evidence. But i am sure it is no coincidence they are all free at the same time. They are just waiting till one of them makes a mistake bij telling something by mail, phone etc. I think there is much more discovered about the four released boys then they tell us.They only have to proove it and i'm sure they will.It will take some time but then they can put them in jail for a very long time.

boys will slip. However, until this travesty changes -- I will NEVER travel to Aruba and I will be
certain to make that comment to
everyone that I meet and work with.
The people of the US need to show

I am not an expert on Dutch law by any means, but this sounds like the rough equivalent of a "suspended sentence" in the US. In this country, you can be found guilty of a crime and sentenced to X number of years in prison, but the judge has the option to suspend the sentence, meaning that the convicted person is sent home, and must adhere to certain conditions (can't leave the state, can't use drugs, etc). The convict's permission to return home does not make him any less guilty.

This appears to be the same case here. The judge ruled that Joran and the K's should be held, so that would indicate that there is still evidence against them. Yes, he sent them home, but they must adhere to certain restrictions.

I don't think we should read very much at all into the fact that these men were released. When a convicted felon is released on a suspended sentence, his family doesn't crow about his "innocence"; similarly, no one from the Kalpoe or VDS families should celebrate the fact that there is "no evidence" against the boys. The judge ruled there WAS evidence, but he just chose to release them as the investigation continues.

THE DECISIONS

The prosecutor filed a motion to prolong the detention of J.v.d.S. with a period of 30 days. This motion was granted by the judge of instruction, but at the same time the judge of instruction has ordered the suspension of the detention of the suspect. This means that the suspect will be set free. There are conditions associated with this suspension that J.v.d.S. has to comply with. If he does not comply with the conditions set upon his suspension by the judge of instruction, the prosecutor can petition the judge of instruction to suspend the suspension of his detention.

In the case of the two brothers S.K. and D.K. the prosecutor filed to motion to prolong their detention with a period of 8 days. The judge of instruction has decided to prolong the detention of the brothers S.K. and D.K. with 8 days. At the same time, he has ordered the suspension of their detention. This means that they will be set free. In their case the judge of instruction has also set conditions S.K. and D.K. have to comply with. If they do not comply with these conditions set upon them by the judge of instruction, the prosecutor can petition the judge of instruction to suspend the suspension of their detention.

NEXT STEP

The prosecutor has appealed the decisions of the judge of instruction in which he suspends the detention of the three suspects S.K., D.K. and J.v.d.S.

Most of the Arubans I have spoken to say this is more like bail than an actualy release. They will still have to come forward for rape and kidnap charges. My understanding of Aruban law is that if you are in the company of someone who is intoxicated and they turn up missing, you can be charged with something along the lines of kidnapping. As for the rape, well the family has said he has admitted to sexual assault, so I wouldn't be so sure there was no proof of this.

ORANJESTAD, Aruba -- A lesbian couple has the right to register their marriage in Aruba, a court ruled Tuesday, rejecting a government appeal in a case that has exposed a cultural rift between Holland and its former colony.

Aruba's Superior Court confirmed a lower court's December ruling that the Caribbean island should register the marriage of Charlene and Esther Oduber-Lamers, who were wed in Holland in 2001.

"The Dutch marriage can be inscribed in the register," read the decision. "Since Aruba is part of the Kingdom of the Netherlands, it must comply with demands of the Kingdom."

The Aruban government now has three months to take the case to Holland's Supreme Court, which it has promised to do.

"We give neither legal nor moral recognition to same-sex marriages," Ruben Trapenberg, spokesman for Aruban Prime Minister Nelson Oduber, said Tuesday.

The women are currently living in Holland and were not immediately available for comment, but the Dutch group Lesbian and Bisexual Federation of the Netherlands praised the ruling.

"It acknowledges that gays and lesbians in Aruba have rights," said Andre van Wanrooij, a spokesman for the Holland-based group.

The women sued Aruba's government for discrimination last year after the Public Registry rejected their marriage certificate. The government argued the civil code did not allow for same-sex marriage and that it would go against Aruba's way of life.

Not having their marriage recognized meant Esther could not get health benefits from Charlene's job at the Aruban Department of Social Affairs or stay on the island for more than six months a year under Aruban immigration laws.

Charlene, a 33-year-old Aruba native, and Esther, a 38-year-old Dutch citizen, fled the island for Holland in November after being harassed when they tried to register as a married couple.

Aruba, which lies off the northern coast of Venezuela, is an autonomous republic that forms part of the Kingdom of the Netherlands.

Dutch statutes require that all members of the Kingdom -- Aruba, Holland and the Dutch Antilles -- recognize each other's legal documents, including marriage certificates.

Holland legalized gay marriage in 2001, but Aruban officials argue that Dutch law also grants the island the right to self-rule -- permitting it to ignore Holland's legalization of gay marriage.

Behind the dispute are deep cultural differences between Holland and Aruba, which shares more with Latin America than Europe.

While Dutch is the official language, most Arubans speak Papiamento, a Creole language that has absorbed words from Spanish, Dutch, English and Portuguese.

More than 80 percent of the island's 97,000 people are Catholic, and the largest number of immigrants come from Venezuela and Colombia.

Few people are openly gay on the island, and locals say many gay residents move to Holland rather than face persecution at home.

Obviously we are disappointed and shocked that any potential charges against Joran are being released. We are hopeful that a certain level of charges are still being considered. We hope the continued interrogation of the Kalpoe and Joran friends can give us more information. We believe the father has information. There were statement implicating such. We think it is appropriate to bring him in for additional questioning.

We are not giving up.

he did something to her, if not why he came up with such an elaborated lie like the holiday inn, he even describe that she fell and hit her head, and that to security guards met with her, i am sure that whatever happended to her have to do with sometype of blow to her head, i m sure that he said that bc if she was found, he would say that she hit her head coming out the car and that he had nothing to do with that,but you know that lies does not stay up forever, wittnes said that that story about the holiday inn was elaborated even people knew she was missing and even before bet holloway arrive to the iland and confronted him, it is ovius that he knows something. i still beleive that she was taken to joran's apartment and after he raped her then his father paul did the same thing, remember anita was allegedly in holland at the time.

But even if that is the case it can be nothing more damageing than the "time served" i.e. 86 days, that is why he has been released.
Another resaon for his release is that he is not a flight risk, and the LE/prosecution have had plenty of time to question him.

Take into account that the judge was shown all that the prosecution has up to this moment !!

The prosecution may continue the case, the judge has nothing to say about that.

And for all of you who just need a guilty person repeat after me (7 times): NO body >>> NO crime >>> NO evidence >>> NO proof >>> NO conviction !!!

To answer my own question, there is the link to a wikipedia entry about Natalee. It appears Joran and Deepak, on the day after Nat went missing, claimed that J and Nat were making out on the beach, and that he then dropped her off at her hotel, whereupon she hit her head but refused help.

Yeah, he just HAPPENED to be the last person to see her before she disappeared. And he just HAPPENED to see her bump her head before he left her. And he just HAPPENED to change his story after days of lying to the cops. It's all a series of innocuous, happenstance occurrences, right?

I would be curious to know what the JVDS supporters think about OJ - innocent or guilty? Seriously...

As a mother, my heart has gone out to all the mothers affected, however, motherhood isn't an excuse for rude and ignorant behaviour. Ok DG, I am not afraid to answer your question on OJ - I truly believe he was and is guilty, but I do not believe that the government proved its case - at least from what I saw of the trial on TV. The police witnesses (Van Atter and Furman) were not credible witnesses - they lied on the stand, in my opinion. So if I had been on the jury, I suspect I would have voted not guilty.

Quite the contrary is true for Michael Jackson, who got off free as a bird. I would have voted guilty from the evidence and testimony that I heard about.

Seemed to be grasping at nothing and then kept adding her own opinions as facts trying to convict them through the media. Like coming up with "They kidnapped her from the bar and she thought she was getting in a cab." What proof of this did Beth have?? None! but it didn't stop her from saying it over and over. This was just one of the MANY stories that she tried to feed the airways. There seemed to be no evidence that a crime was committed or they wouldn't have let them go at this time. More to the point for many on this site there is too much bashing and name calling. A girl is missing. A young man's life has been changed forever. Those are tragic facts. Could someone explain to me why Beth Twitty can go to Aruba every week for a couple of days, but recommends that no one else travel there. Odd that she feels safe there while slandering the government and the police for their "absolutely huge" cover-up. I hope that she find a thesaurus and learns some new adjectives. Goodness, those two words are still ringing in my ears. Seems like all of the media starting using those two words also to describe everything.

We are with Beth, all the way! If she had not been there all this time, the Three Amigos would have walked long ago. Beth is going to make SURE that this case does not go away, even if the American public has to fund her two days per week in Aruba. And, newsflash...this week, the cable media called her to assure her that THEY have not forgotten Natalee. They will be back to Aruba soon. Hope the ALE and the gov't is ready for some dirty little secrets that are about to come out...sometime tomorrow on US national television. So, all you Joran fans, be sure and tune in!
